INTRODUCTION

These clauses establish the general conditions of purchase that regulate the purchase of products available through the pldspace.com website (hereinafter, the Site) in exchange for the corresponding economic consideration.

The placing of a purchase order constitutes your agreement to these terms and conditions (you have accepted these terms and conditions by clicking the appropriate consent checkbox), whereby you are aware that you are bound by the terms and conditions set out on our website.

Notwithstanding the above, should you have any questions about them, you can contact us through our contact channels.

By placing an order on the website, the user confirms that they are over 18 years of age and have sufficient legal capacity to enter into the contract. The articles offered on this website are only available for delivery to Spanish territory (including Ceuta, Melilla, the Canary Islands and/or the Balearic Islands). However, shipping costs vary depending on the point of delivery.

SITE TRANSACTIONS

We reserve the right to refuse any order you place with us. We may, at our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card and/or orders using the same invoicing and/or shipping address. In the event that we make a change to or cancel an order, we will attempt to notify you by contacting the email and/or invoicing address/phone number provided at the time the order was placed. We reserve the right to limit or prohibit orders that, at our sole discretion, appear to have been placed by dealers, resellers or distributors. For each transaction, we will charge your payment method upon shipment of your order.

You agree that we shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Site, or any service, content, feature or product offered through the Site.

 

Unless otherwise noted, the Site and all features and materials on the Site, including text, images, illustrations, designs, icons, photographs, video clips and other content, and the copyrights, trademarks, commercial images, and/or other intellectual property in such materials (collectively, the “Content”), are owned, controlled or licensed by Space Exploration Technologies Corp. (”SpaceX”) and other trademarks appearing on the Site are trademarks of SpaceX and/or its subsidiaries.

PLACE AN ORDER

Orders may only be placed by users who are registered as customers on the website. User data will be processed in accordance with the provisions of the privacy policy. In case of any error in entering your data, please contact our customer service department as soon as possible.

Once you have selected all the items you wish to purchase, they will have been added to your shopping basket and the next step is to process the order and make payment.

In order to place an order you have to follow the online purchase procedure, selecting the shipping method and method of payment and click on “continue”. To do this, you must follow the steps of the purchase process, filling in or checking the information requested at each step. Before confirming the purchase order, the user will be presented with a summary of the order identifying the item purchased, its total price (transport and taxes included) with each of the items broken down, and the shipping details of the order, so that the user can confirm the order by clicking on the “continue” button.

Once the order has been placed, you will receive an order confirmation by email at the address indicated by the user with a description of the order and the personal details provided to acknowledge receipt of the order. The non-receipt of this message may be due to a temporary communications problem in the network or a typing error in the email address provided. In both cases, PLD Space recommends the user to contact the customer service department. Similarly, the user will receive email confirmation that the product has been shipped.

PRICES AND PAYMENT METHODS

The prices on the website are shown in euros.

The prices indicated on our website are valid for the whole of Spain, although delivery costs may vary depending on the destination to which the items are to be sent. In accordance with the provisions of article 68 of Law 37/1992, of 28 December, on Value Added Tax, the delivery of the articles shall be understood to be located in the territory where Spanish VAT applies if the delivery address is in Spanish territory, except for the Canary Islands, Ceuta and Melilla. The applicable VAT rate will be that legally in force at any given time depending on the specific article in question.

For orders destined for the Canary Islands, Ceuta and Melilla, deliveries will be exempt from VAT in accordance with the provisions of article 21 of Law 37/1992, without prejudice to the application of the corresponding taxes and/or tariffs in accordance with the regulations in force in each of these territories.

Shipping costs shall be borne by the customer. Duties and other costs in the country of destination shall also be borne by the customer. For purchases over €60, shipping costs will be free of charge for the customer.

You expressly authorize us to issue the invoicing in electronic format, although you may at any time indicate your wish to receive an invoice in paper format, in which case we will issue and send the invoice in this format at no additional cost.

Credit and/or debit cards in the payment gateway enabled for this purpose. To make this payment we will need to enter your card details for the sole purpose of making the payment for the purchase of the products.

No additional charges other than those specifically provided for in these terms and conditions of sale will be accepted. Please note that credit cards are subject to verification and/or authorization by the credit card issuer, but if the issuer does not authorize payment, we cannot be held responsible for any delay or non-delivery and the contract with the user will not be formalized.

AVAILABILITY

All orders are subject to product availability. If at the time of issuing the order we detect that there is no stock available, we will inform you and the item that has been charged and not shipped will be credited to the customer in the ensuing days, by the same payment method used in the purchase, refunding any amount that may have been paid for that item.

DELIVERY

Unless there are circumstances arising from the personalization of the articles, or except in cases of force majeure, understood as unforeseen or extraordinary circumstances, we will send you the order within a maximum period of 30 days from the confirmation of the order.

In the event that we are unable to meet the delivery date mentioned above, we will inform you of this circumstance and offer you the possibility of continuing with the purchase by setting a new delivery date or the possibility of cancelling the order with a full refund of the amount paid.

Non-delivery shall not be considered as such if the transport agency has not been able to locate the purchaser using the data provided by the latter.

We inform you that the transport agency will deliver from Monday to Friday during business hours. If it is impossible to deliver your order, we will try to find a safe place to leave it. If we are unable to find a safe place, your order will be returned to our warehouse. We will also inform you of the location of your order and how to arrange for it to be re-delivered to you. If you will not be present at the delivery location at the agreed time, please contact us to arrange delivery on another day.

In the event that 15 days have elapsed since the order is available for delivery and it has not been delivered for reasons not attributable to us, we will understand that the user wishes to withdraw from the contract and it will be considered as terminated. We will refund the payments received by the user, including delivery charges, with the exception of additional charges in the event that the user has chosen a delivery method other than the least expensive delivery method offered by us, without undue delay and, in any case, within a maximum period of 14 days after the contract is deemed to be terminated.

Please note that the transport costs for the resolution may be additional and we will be entitled to charge you for the costs of returning the goods.

RETURNS AND EXCHANGES

If upon receipt of the purchase the customer is not satisfied, PLD Space allows you to change the size of the item purchased or return it within fourteen (14) days from the date of receipt, provided that the product has not been used or damaged. Proof of purchase must be attached. PLD Space may not accept exchanges or returns of products that are used or damaged.

The product return or exchange of size may be made by ordinary mail to the following address: Elche Parque Empresarial, Calle Marie Curie, 23, 03203 Elche (Alicante), Spain.

PLD Space advises you to send the return by registered post or with acknowledgement of receipt.

The shipping costs for products that you wish to exchange or return by post will be paid by the customer. Under no circumstances will PLD Space accept returns sent freight collect.

COLOURS AND STYLE

We have made every effort to display as accurately as possible the colours and styles of our products that appear on the Site. We cannot guarantee that your computer monitor’s display of any colour or style will be accurate.

RIGHT OF WITHDRAWAL

The customer has the right to withdraw from this contract within fourteen (14) calendar days without giving any reason.

The withdrawal period will expire fourteen (14) calendar days after the day on which you (or a third party indicated by you) purchase the goods. To meet the withdrawal period, it is sufficient that the communication concerning the exercise of this right is sent before the expiry of the withdrawal period.

To exercise your right of withdrawal, you must notify us at our address Elche Parque Empresarial, Calle Marie Curie, 23, 03203 Elche (Alicante), Spain, or via email to media@pldspace.com of your decision to withdraw from the contract. For this purpose, we provide you with a model withdrawal form below. (Merely fill in and send this form if you wish to withdraw from the contract.)

CONSEQUENCES OF WITHDRAWAL

In the event of withdrawal, we will refund to the customer all payments received after the purchase, including delivery charges (with the exception of additional charges resulting from the customer’s choice of a delivery method other than the least expensive standard delivery method offered by us) without undue delay and in any event not later than fourteen (14) calendar days from the date on which we are informed of the decision to withdraw from this contract.

We will carry out such reimbursement using the same means of payment used by the customer for the initial transaction, unless the customer has expressly provided otherwise. In any case, you will not incur any costs as a result of the refund.

We may withhold reimbursement until we have received the goods, or until the customer has provided proof of return of the goods, whichever condition is met first.

The customer must return or hand over the goods directly to us without undue delay and in any event not later than fourteen (14) calendar days from the date on which they inform us of their decision to withdraw from the contract. The deadline shall be deemed to have been met if the customer returns the goods before this period has expired.

REFUND

Once the product has been received, PLD Space will verify that it is in good condition and will proceed to send the required size if an exchange has been requested or will proceed to refund the amount through the same payment method used by the customer in the case of return.

The refund period can vary from 2 to 5 working days after the return is received by PLD Space. Once the status of the returned items has been verified, the customer will be informed via email.

In the case of exercising the right of withdrawal of the order, the maximum period for the refund of the amount paid by the consumer for the products will be fourteen (14) calendar days from the withdrawal.

Payment for returned goods will always be made in the same payment method used for the purchase.

DEFECTIVE PRODUCTS

In the event that you consider that at the time of delivery the product does not conform to the contract, you must contact us immediately through our contact channels, providing details of the product and the damage it has suffered. We will carefully examine the returned product and will inform you by email within a reasonable period of time whether we will refund or replace the product, if applicable. The refund or replacement of the item will be made as soon as possible and in any event within fourteen (14) days from the date on which we send you an email confirming the refund or replacement of the non-conforming item.

Amounts paid for goods which are returned to us because of a defect, where such a defect actually exists, will be refunded to you in full, including the delivery charges incurred in delivering the item to you and the costs incurred by you in returning the item to us.

The refund will be made through the same payment method that was used to pay for the purchase.

GUARANTEES

If you contract as a consumer and user, we offer guarantees on the products that we market through this Site, in the terms legally established for each type of product, responding, therefore, for the lack of conformity of the same that is manifested within three years from the delivery of the product.

WAIVER

Our failure to require your strict performance of any of your obligations under a contract or these terms and conditions or our failure to exercise any rights or remedies to which we may be entitled under such contract or these terms and conditions shall not constitute a waiver or limitation of such rights or remedies or relieve you of any such obligations.

No waiver by us of any particular right or remedy shall constitute a waiver of any other right or remedy arising under a contract or the terms and conditions. No waiver by us of any of these terms and conditions or of any rights or remedies arising under any contract shall be effective unless it is expressly stated to be a waiver and is made and communicated to you in writing.

LANGUAGE

The language applicable to these conditions is Spanish. Any version in another language provided by PLD Space is offered for the convenience of the user and to make it easier to understand.

In case of contradiction between the conditions in any language and the Spanish version, the Spanish version shall prevail.


POSSIBLE CHANGES

PLD reserves the right to modify these conditions. We will keep you informed of substantial changes to them.

The amendments made shall not be retroactive.

If you do not agree with the amendments made, we recommend that you do not use the website.


COMPLAINTS, CLAIMS AND OUT-OF-COURT SETTLEMENTS OF DISPUTES

For any complaints or claims, please contact us through the forms provided on the website, or by using the phone number, e-mail or postal addresses provided.

Furthermore, official complaint forms are available to consumers and users. Your complaints and claims will be dealt with at as soon as possible and, in any event, within the time limit laid down by law. In the event of a complaint or claim, we will provide you with an identification number, which we will bring to your attention.

If you consider that, as a consumer and/or user, the rights you are legally entitled to have been infringed, you can address your complaint or claim to us by e-mail at media@pldspace.com for the purpose of requesting an out-of-court settlement of your dispute.

Furthermore, in the event that the purchase between the consumer and/or users and PLD is online through our website, in accordance with the provisions provided for in EU Regulation 524/2013, please be informed that you have the right to request an out-of-court settlement of your dispute in the area accessible via the Internet address http://ec.europa.eu/consumers/odr/.

PARTIAL INVALIDITY OF CLAUSES

In the event that any of these terms and conditions, or any provision of a contract, is declared null and void by a final decision of the competent authority, the remaining terms and conditions shall remain in force and shall not be affected by such declaration of nullity.

FULL AGREEMENT

These Terms and Conditions and any document expressly referred to in these Terms and Conditions constitute the entire agreement between you and PLD in relation to the subject matter hereof and supersede any prior agreements or understandings previously agreed between you and PLD.

You and we acknowledge that we have consented to the conclusion of a contract without having relied on any representation or promise made by the other party or which could be inferred from any statement or writing in the negotiations between us prior to the contract, except as expressly set out in these terms and conditions.

JURISDICTION AND APPLICABLE LAW

The use of the website and contracts of purchase through the website shall be governed by Spanish law. Any dispute arising out of or in connection with the use of the website and/or such contracts shall be subject to Spanish jurisdiction.

In the case of a consumer, nothing in this clause shall affect the consumer’s rights under applicable law.
